The National association for the protection and welfare for animals (ANPBA), made an important step forward regarding the report filed of two hanged galgos in a piece of land in the province of Murcia last August. In many parts of Spain there is a horrific tradition of hanging galgos when they are no longer useful to their owners and only recently has it been possible to legally persue these happenings. There is another tradition in Spain which is to not report cruelty inflicted upon animals since this takes time, courage and the will to confront the passiveness and the delay with which the authorities react before these happenings. Even so, Spain carries on evolving and there is an increasing number of people willing to break this vicious circle: thanks to ANPBA, to the SEPRONA police agents and to all the people who don't need a reason to act. Let's hope that the horrible way in which these two galgos die don't go unseen by the law and that increasingly more 'criminals' receive the punishment they deserve, for the animals' sake and of those people around them. greyhounds in the surroundings of Cehegín (Murcia) A
formal complaint was filed by ANPBA to SEPRONA After
knowing about the hanging of 2 greyhounds in a property amongst Bullas
and Cehegín, the 5th of August 2005, the National
Association on behalf of Protection and welfare of Nature (ANPBA) filed
an administrative complaint against the Nature Protection Service (SEPRONA)
of the CIVIL GUARD, enclosing graphic documentation. ANPBA required
starting “an official investigation in order to identify the crime
perpetrators so as to punish them according to the legal planned law” For

appealed the law: Ley Orgánica 15/2003,
by which the law: Ley
Orgánica 10/1999 of
the Spanish penal code was modified. This
one establishes that: “Those who ill-treat domestic animals with
ferocity and unjustified behaviour, causing their death or severe
physical harm, will be punished with imprisonment from 3 months up to
one year. (Art.
337) Concerning
the current legality applicable in the region of Murcia, the law: 10/1990
of protection and defence of domestic animals, bans
“animal ill-treatment or the practise of any unjustified harm or
suffering towards them” (art.2) it is considered as serious
infringement “ill-treatment or physical attacks to animals” (art
24.3c), under fine punishment up to 15.000€ CIVIL
GUARD PROCEEDING: COMPLAINT
TO THE JURISDICTION COURT OF CARAVACA We
have legally received signed note from the sergeant in charge of the
SEPRONA team. C.C.M. (enclosed), in which we are informed, related to
the complaint made by ANPBA, that: after having made inquiries to
identify the presumed perpetrator, the information was addressed through
official report number 53/05,
to the Caravaca de la Cruz (Murcia) jurisdiction court. Civil
Guard always keeps private –names and data- of any person identified
and denounced, having recourse to established legal terms about data
protection. They only communicate to the person who reports the crime
occurred. However, a penal complaint is not transferred to the legal
court until the identity of the presumed perpetrator is not determined. This
has already happened and takes shape in the previous steps done
by SEPRONA “focused to find out the real responsible”, mentioned in
the official report, and whose content is as follows: Addressee:

performance of the established on article 35.1 of the Law of legal rules
of public administration and following the administrative proceeding, I
hereby inform that the complaint reported by V., dated 5th of
August, based on the knowledge of two hanged greyhounds in the district
of Cehegín (Murcia), once done the appropriate steps to find out the
presumed perpetrator, is transferred by report nº 53/05, to the
preliminary court on duty of the Guardia de Caravaca de la Cruz (Murcia) The

EVALUATION Alfonso
Chillerón, president of the ANPBA, has stated: “We value in the most
positive way, the behaviour of SEPRONA, and the interest showed in the
resolution of the case. Now, ANPBA will turn up in the penal cause and
will request the maximum possible punishment for the presumed
perpetrator of these abominable crimes against the animals. Penal Code
contemplates penalties up to one year of imprisonment -Press Department. |
